1. Personal Information:

Any personal information provided to or gathered by Jion Martial Arts is controlled by Acosports CC trading as Jion Martial Arts Centre, whose registered office is at 9 Parade Crescent, Constantia Hills, Cape Town, South Africa.

2. What personal information does Jion Martial Arts collect?

The information we collect from our members help us to continually improve your experience at Jion Martial Arts. We also collect personal information from website users.

The personal information we collect may include your name and contact information; age, gender, ID/passport number; date of birth; registration number, preferred communication methods; bank details and credit card details. We also create information that becomes part of the personal information we hold about you, such as your membership number and your usage of the club. We also collect the following information:

Special personal information: The term “special personal information” in this context refers to information relating to your religious or philosophical beliefs, race or ethnic origin, trade union membership, political opinions, health, sexual life or criminal behaviour. Whilst we do not generally collect special personal information unless it is volunteered by you, we do specifically collect (i) health data to the extent that it is required to assess your readiness for physical exercise, and/or (ii) your access information to the extent that you are part of a medical scheme rewards or retention programme. We will use health data or health information and/or access information provided by you (or retrieved from you each time you access our facilities or use our services inside our facilities or on our online platforms), exclusively to (i) share with the medical scheme rewards partner (if applicable) that you have joined Jion Martial Arts through, or (ii) serve you better and meet your particular needs. We also collect photographs (as discussed below) and may collect fingerprints for identification and fraud prevention. In limited circumstances (such as for membership demographic analysis purposes) we may collect information about your race and mental health. By providing this information to us, you are consenting to our using it in the manner set out in this policy.
Personal information about children: We do not knowingly collect personal information from children (under 18 years of age) without the permission of their parents or guardian. As a parent or guardian, please do not allow your children to submit personal information without your permission.
Photographs for your Jion Martial Arts membership card: In the interests of security and the prevention of crime, or for purposes of enabling the enforcement of our Rules, we take a digital photograph of each member to whom a membership card is issued. By providing the digital photograph to us, you are consenting to our using it in the manner set out in this policy.
Contacting us via our Websites or otherwise: When you use the co.za, www.ipponsports.co.za or www.gyph.co.za websites (our “Sites”) or any Jion Martial Arts mobile application, online platform or contact us by post, telephone, email, SMS or WhatsApp, we collect, store and use certain personal information that you disclose to us. This includes details such as your name, address, telephone, email and mobile phone number as well as traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access. If you contact us, we may keep a record of that correspondence.
CCTV: We use CCTV in our facilities for health, safety and security reasons, or for purposes of enabling the enforcement of our Rules. If you have any queries in relation to the use of CCTV operating in and around our dojo please contact us.
Surveys: We may ask you to complete surveys for research purposes from time to time, although you do not have to respond to them.

3. What do we do with personal information collected from you?

We use personal information for the following or related purposes:

To provide the services you request from Jion Martial Arts such as to facilitate operational appointments (in the case of independent contractors), administration of your membership, facilitate bookings of classes and appointments with our own or third party service providers and other transactions;
To advertise (including by means of direct marketing) products and services;
To process payments (including by means of debit orders), such as membership fees, annual affiliation fees and any other payments that may be due to us from you or the other way around;
To process member benefits;
To run or manage (i) rewards programmes, (ii) loyalty programmes, or (iii) to facilitate the interaction between us and any other third party you may have joined Jion Martial Arts through;
To maintain accounts and records;
To prevent crime and aid in the prosecution of offenders;
To administer and maintain membership records;
To improve our membership and customer services platform;
To prevent or detect fraud or abuses of our website or services;
To enable third parties to carry out technical, logistical or other functions on our behalf;
To send you newsletters and promotions, and to conduct online surveys or surveys by telephone; prize draws; competitions and other promotions via email, telephone or post;
If you subsequently apply for employment at Jion Martial Arts, to process your job application;
To continuously profile and assess our membership data base in order to improve the service offering provided to members and/or to better align ourselves with business partners;
To assess job applications;
To process purchase orders;
To manage debit order disputes;
To add data subjects to a “do not call list” if they opt-out from receiving direct marketing from us;
To update personal information;
To assess membership demographics;
To run and manage various campaigns, such as collections, arrears notices and any communication which affects a member’s contract or access to a Jion Martial Arts facility;
To conduct social media scans;
To share it with existing and potential business partners and third parties in order to identify mutual commercial opportunities with such business partners or third parties, and/or improve the service offering to you. We operate an automatic opt-in policy which means that when you request information from us on one of our clubs or make an enquiry we add you to our database.

4. What about Cookies?

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognise your browser and to automatically collect information from your computer such as your IP address and other details about your computer which are automatically collected by our web server, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual. The “Help” menu on the menu bar of most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie and how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as flash cookies, by changing the add-on’s settings or visiting the website of its manufacturer. 5. Does Jion Martial Arts share the information it receives?

Information about our members is an important part of our business and we do not sell it to others. Jion Martial Arts shares member information only as described below.

Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include sending postal mail and email, managing legal and financial communications, removing repetitive information from member lists, analysing data, storage and providing marketing assistance. Third-party service providers have access to personal information needed to perform their functions, but may not use it for other purposes. Further, they must process the personal information in accordance with this privacy policy and as permitted by South African data protection legislation.
Banks: We share personal information with banks to process debit orders or to do bank account verification of suppliers and to prevent fraud.
Pension Funds and Medical Aids and other Third Parties: We share information with these entities for employment related purposes.
Business Transfers: As we continue to develop our business, we might sell or buy health clubs or subsidiaries or business units. In such transactions, member information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy (unless, of course, the member consents otherwise). Also, in the unlikely event that Jion Martial Arts or substantially all of its assets are acquired, personal information will of course be one of the transferred assets.
Regulators or State Departments: We share information with local or foreign regulators and/or State Departments, including tax authorities and the Department of Labour, if we are required or permitted to do so in terms of applicable laws.
Protection of Jion Martial Arts and others. We release account and other personal information when we believe that such a release is appropriate to comply with the law; enforce or apply our membership or other agreements; or protect the rights, property or safety of Jion Martial Arts, our users or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, sharing or otherwise disclosing personally identifiable information from members for commercial purposes in a way that is contrary to the commitments made in this policy.

Information is shared on a confidential basis, and unless you have consented otherwise, under no circumstances is the business partner or third party entitled to make any communication to you, or make any further transmission of the information, as a result of the personal information we share with them. Each transmission of the personal information with the business partner or third party differs but is specific to the particular information share exercise being undertaken.

Other than as set out in this policy we will not share your personal information with third parties for marketing or any other purposes without your consent, unless we are required to do so by law. You will receive notice when information about you might go to third parties and you will have an opportunity to choose not to share the information.

THE DOJO

Jion Martial Arts and Fitness Centre, Jion or hereafter also referred to as the “Dojo” will refer to Acosports CC and all contractual references or obligations will be to Acosports CC

RULES AND REGULATIONS

The member agrees to obey the rules and regulations as established by the Management of The Dojo. These rules and regulations may be amended from time to time and may be orally communicated or contained on signs posted in The Dojo. All rules and regulations are available upon request and the member confirms that they are fully conversant with them and undertakes to always abide by them.

CLOTHING AND HYGIENE

The Dojo reserves the right to deny the use of The Dojo to any person whose attire is not considered to be appropriate in connection with the public image of The Dojo and its rules and regulations. No black-soled shoes are permitted on the studio floor. No topless training will be allowed. Members are required to always carry with them personal towels while exercising or training and shall use the towel to wipe equipment and upholstery clean or their immediate training area from any spillage.

DEFAULT

Should the member fail to pay an/any amount due by him/her to The Dojo on the due date therefor, or breach any term or condition of this agreement, or of The Dojo’s rules and regulations, or should The Dojo, acting reasonably, regard the member’s general conduct as unacceptable, The Dojo should have the right to summarily suspend or terminate such member’s membership, at The Dojo’s sole and absolute discretion. Notwithstanding such suspension or cancellation, in the event of non-payment or any amount due by the member to The Dojo including any bank charges that occurred due to the default will be payable by the member, the full contract price due by the member of The Dojo shall become immediately due, owing and payable.

FREEZING OF A CONTRACT

Contracts cannot be frozen for any reason unless written approval is obtained from The Dojo manager, along with proof of a doctor’s note or proof of travel. This contract may be frozen for a minimum of 1 (one) calendar month to a maximum of 6 (six) months in a twelve-month cycle, for medical reasons or travelling abroad. A twenty rand suspension levy will be due per month for the term requested and will still be extended at the end of the existing contract. After the six-month period has expired and the student hasn’t returned his membership will be cancelled. Freezing of the contract does not affect the member’s contractual obligation to 12-month courses.

MEMBERSHIP FEES

The member will not be released from the obligations about any payment of the membership fees as agreed to herein. The member is not entitled to any deduction or allowance for any payment made by reason of the member’s absence or withdrawal from The Dojo, nor by the member’s failure to attend or utilise the facilities of The Dojo. Course or membership fees are strictly non-refundable.

SERVICE FEES AND LEVIES

The member is liable to The Dojo for payment of the course fees as reflected in our correspondence and the debit order instruction. The member authorizes The Dojo to make charges to or withdrawals from such account as specified by the member in respect of the membership fees, yearly registration, and affiliation fees and/or monthly service fees. Should the official VAT rate increase, all fees and levies shall be increased in accordance with thereof. Debit Order instructions are at a discounted rate.

ANCILLARY CHARGES

Further charges may be levied for private training sessions, special training programs, meal plans or other service-related programs.

CANCELLATION & PENALTIES

Cancellation of the contract will only be accepted in writing. Yearly contracts may be cancelled earlier by law, but a cancellation fee of 2 months’ notice will be charged as well as discounts will be recouped.

CLOSURE OF DOJO AND/OR ALTERNATION OF HOURS

In the event of The Dojo, at its discretion, deciding that necessary maintenance work should be done to The Dojo’s premises, The Dojo may close its facilities for the period required for completion of the necessary maintenance.

– If at the discretion of The Dojo management and due to unforeseen circumstances, a Dojo must be closed on a permanent basis, Jion Martial Arts and Fitness Centre reserves the right however is not obliged to provide an alternative facility, within a 10km (TEN) radius, for use by the members.

– The Dojo hours will be displayed, and The Dojo management reserves the right to change The Dojo hours from time to time or as may be deemed necessary.

– Equipment and classes are available subject to demand. The classes may be discontinued, or the time thereof altered at the sole discretion of The Dojo management.

– Under no circumstances shall the member, or any third party, have any claim of whatsoever nature against The Dojo arising out of, or consequent to, this closure.

– If Jion Martial Arts and Fitness Centre cannot provide an alternative venue for the member to resume their training the member will not be charged the normal pro-rata monthly subscription until the situation is resolved

DAMAGE TO PROPERTY OF THIRD PARTY/IES BY MEMBERS

The member hereby indemnifies The Dojo and holds The Dojo harmless against all claims arising out of the damage of the property of third party/ies, including but not limited to, The Dojo’s strategic alliance partners, caused by the member, his/her dependents, guest or third party/ies, whether caused intentionally or accidentally.

LIMITATION OF LIABILITIES

I agree and acknowledge that Acosports CC will not be liable for death, injury, loss or damage suffered by me and/or the member(s) through or contributed to by any cause whatsoever including but limited to, any negligent (including grossly negligent) act and/or omission or breach of contract on the part of Jion Martial Arts and Fitness Centre, its directors, employees, contractors, independent consultants, or other members. I agree and acknowledge that I enter and exit the premises (inclusive of the parking areas) and use the equipment and facilities entirely at my own risk. In addition, I agree Jion Martial Arts and Fitness Centre shall not be vicariously liable for any loss or damages suffered by me and/or other member(s) because of theft on the part of its employees, independent contractors, consultants, or other member(s). I and/or my estate hereby indemnify Jion Martial Arts and Fitness Centre against any claim by any person arising directly or indirectly from my death, injury, loss, or damage suffered by a member, allegedly caused or contributed to by an act or omission by Jion Martial Arts and Fitness Centre, it’s directors, employees, contractors, consultants and agents.

VALUABLES AND PERSONAL PROPERTY

The Dojo will not be responsible for any loss, theft, or damage to personal property of the member, their dependents, guests or any third party/ies. The member agrees to waive any right to sue The Dojo for loss or stolen articles.

NON-VARIATION OF AGREEMENT

This is the entire agreement between parties and no representation, promise, warranty and/or agreement not contained herein shall be of any force and effect between the parties. No extension of time or other indulgence granted to the member by The Dojo in any way prejudice of The Dojo’s rights in terms of this agreement.

RIGHT OF ADMISSION RESERVED

The Dojo hereby reserves its rights to enter into this agreement with, or to grant membership of, or access to The Dojo to, any person, at The Dojo’s sole and absolute discretion.

PERSONAL TRAINING

The Dojo does not permit unauthorized personal training on its premises. Unauthorized personal training may lead to the suspension or expulsion of both/all party/ies involved in such personal training, at The Dojo’s sole and absolute discretion.

INTEREST AND OTHER CHARGES

The member will be liable to pay The Dojo, interest on all arrears amounts at the rate charged on the overdraft accounts plus 2% per month as charged by ABSA Bank (“the bank”) as certified by any manager of any branch of the bank, whose appointment and authority it shall not be necessary to prove, calculated monthly in advance as from the due date for payment of such amounts to date of final payment. The interest calculated as aforesaid shall be capitalised as and when it is calculated and shall thereupon form a portion of the amount outstanding for the calculation of interest thereafter.

Should The Dojo institute legal proceedings against the member arising out of the member’s breach of this agreement and/or The Dojo’s rules and regulations, or for any reason whatsoever, the member will be liable to The Dojo for tracing fees collection, commission and/or legal cost incurred by The Dojo on the scale as between attorney and own client.

DOMICILIUM CITANDI ET EXECUTANDI

For the purpose of this agreement, including the giving of any notice required or permitted hereunder and any proceedings which may be instituted by virtue hereof, the member chooses his/her physical address, as set out on the face of this document. To be their Domicilium citandi et executandi. In the event of the member’s Domicilum address changing, the member is obliged to inform The Dojo thereof in writing, within 30 (THIRTY) days from the date of such change.

CERTIFICATE OF INDEBTEDNESS

A certificate purporting to be signed by or on behalf of The Dojo (it not being necessary for The Dojo to prove the appointment or authority of the person signing such certificate) specifying the amount of the member’s indebtedness to The Dojo (including all applicable costs and interest, as well as the rate thereof and the period for which it is applicable) and further stating that the same is due, owing and payable, shall be sufficient and satisfactory proof of all matters contained herein including the amount and validity of such indebtedness and the fact that same is due, owing and payable shall be sufficient and satisfactory proof of and entitle The Dojo to obtain judgement by consent, provisional sentence, summary judgement or default judgement in terms of this agreement.

CONSENT TO JUDGEMENT

In the event that it becomes necessary for The Dojo to take legal action against the member, the member hereby irrevocably consents to judgement being granted against themselves in the amount as stated in the certificate of indebtedness. The member hereby consents to emoluments order being granted against the member, which emoluments order shall be for an amount equal to the monthly indebtedness of the member to The Dojo hereunder and any bank charges as a result of the above.

STRATEGIC ALLIANCES

Jion Martial Arts and Fitness Centre reserves the right to allow our approved Strategic Alliance Partners access to our database for marketing purposes.
